65 Delmar Avenue Framingham, MA 01701 508-877-5541 hjw2001@gmail.com September 2, 2008 Framingham Police Department 1 William Welch way Framingham, MA 01702 Attn: Police Chief Steven Carl Dear Mr. Carl, On September 2, 2008 around 8:22 AM I took pictures of a Framingham police motorcycle (License M7945, Special Operations) as usual parking in a handicap outlined area while fetching coffee at the beginning of his shift. I took a few pictures. http://www.abetterframingham.org/police-handicapped.html September 2, 2008 ar 8:22 AM I'd like some answers to some questions. 1. What is the official policy of the Framingham police force on parking in areas that are stripped with white lines around handicap parking? 2. Is this a good example for the community? This officer came out of Dunkin Donuts to take a picture of me (with his cell phone) in the Dunkin Donuts parking lot and that's OK with me. It was his next step that crosses over into harassment. I left Dunkin Donuts around 8:33 AM and this officer followed me on his motorcycle. I took a right on Rt. 30 and was in the right lane waiting for the light at Burr Street. The officer then came up to my car in the right turn only lane and took another picture of me with his cell phone. I would like the officer's name. I would like his cell phone confiscated from him to be used as evidence against him in a charge of harrassment and intimidation. 65 Delmar Avenue Framingham, MA 01701 December 8, 2008 Framingham Police Department 1 William Welch Lane Framingham, MA 01702 Attn: Steven Carl Dear sir, Thank you for your investigation on my complaint concerning the motorcycle officer who pursued me out of Dunkin Donuts and then claimed to not take a picture of me on September 2, 2008. My complaint and your response are documented at: http://www.abetterframingham.org/police-complaint-20080902-0822.html I have four questions concerning the incident. 1. May I get a copy of Lt. Michael Hill's report on the incident? 2. Did officer Owen Babineau know who he was pursuing? Did he know my name prior to the incident? This question was in my original complaint but went unanswered. 3. On what date did you examine his cell phone to determine whether it had a camera? 4. What was the officer's rationale or motivation for coming after me? Were his actions within the scope of his law enforcement duties? I do not believe that it is appropriate for a town employee, particularly a police officer to come after me the way he did pretending to use the color of law. In my opinion, it did not seem warranted. I would like to file charges against Officer Babineau. I want him arrested, fingerprinted and charged with: - deliberate and wanton harrassment and intimidation - using the color of law to harass and intimidate - misuse of town property to do such harassment/intimidation - failing to turn on a turn only lane - abuse of police authority He can then explain to a judge his motivation and purpose as to why he pursued me allegedly faked taking pictures of me. It will be a good test of your role as the chief law enforcement officer for the Town of Framingham. You did not have any issues in stopping me on my early morning walk but I want to see how you handle the issue of your own staff violating laws in a blatant manner. I am interested in filing charges against Officer Owen Babineau. - deliberate and wanton harrassment and intimidation - using the color of law to harass and intimidate - misuse of town property to do such harassment/intimidation - failing to turn on a turn only lane - parking his police motorcycle in a handicap area - abuse of police authority I have processed this as far as I can through the Framingham police department. This is a case of a twenty (20) year veteran of the Framingham police department who planned to harass and intimidate a citizen, with malicious intent, but the police chief calls it "inappropriate".
