FRAMINGHAM - The brother of a Framingham police sergeant admitted to downloading numerous child pornography files in the past few months, a prosecutor said yesterday in Framingham District Court.

Kevin Keith, 61, was arrested Wednesday at the police station at 2:30 p.m. after his brother, Sgt. Marty Keith, convinced him to meet with detectives, prosecutor Dannon Stacer said.

On Monday, Kevin Keith's younger sister told Marty Keith that she saw pornography on Kevin's laptop at the family's home at 116 Fenwick St., the prosecutor said.

"This was concerning to the Keith family because Kevin Keith is a Level 1 sex offender due to his past conviction for possession of child pornography and indecent assault and battery on a child younger than 14," a police report filed by Detective Dave Delprete said.

Marty Keith kicked Kevin Keith out of the home and brought the computer to the police station. Detectives said they could not look at the computer without Kevin Keith's permission. Kevin Keith said no, and asked Marty Keith to bring him some clothing to the Motel 6 in Framingham, where he was staying, Stacer said.

"When he was in his (Kevin Keith's) sock drawer, he found two DVDs,' Stacer said.

Marty Keith questioned his brother who admitted the DVDs contained child pornography. He said there was also child pornography on the computer as well as two thumb drives, Stacer said.

Marty Keith convinced his brother to go to the station. There, Kevin Keith admitted to detectives that he had downloaded child pornography and made DVDs from them. He told detectives he started looking at the child pornography about eight months ago when he lost his job, Stacer said.

Kevin Keith was arrested and charged with possession of child pornography (subsequent offense).

Stacer asked Judge Robert Harbour to hold Keith on $10,000 bail.

Keith's lawyer, Joss Filiault, asked for the $1,500 bail that a bail commissioner set after Keith's arrest on Wednesday.

"His brother convinced him to cooperate with police," said Filiault. "He turned himself in to the police department, knowing full well he was going to be arrested."

Harbour ordered Keith held on $7,500 bail. He also ordered Keith to have no contact with children younger than 16, and banned him from using the Internet.

Keith is due back in court on Aug. 6 for a pretrial conference.

Framingham Police sergeant's brother indicted on child porn charges September 15, 2012

FRAMINGHAM -- The brother of a Framingham Police sergeant has been indicted on child porn charges by a Middlesex County Grand Jury, District Attorney Gerry Leone announced Friday.

Kevin Keith, 61, was indicted on three counts of possession of child pornography-subsequent-offense, Leone said. He was arrested in July after his brother, Sgt. Marty Keith, convinced him to meet with detectives, prosecutor Dannon Stacer said at Keith's July 12 arraignment in Framingham District Court.

Stacer said Kevin Keith’s younger sister told Sgt. Keith that she saw pornography on the man’s laptop at the family home at 116 Fenwick St.

This was a concern, police wrote in a report, because Kevin Keith is a Level 1 sex offender, having been previously convicted on charges of possession of child pornography and indecent assault and battery on a child younger than 14.

Marty Keith kicked his brother out of the home and brought his computer to the police station, however detectives said they couldn’t look at the computer without Kevin Keith’s permission.

The man said no, and asked his brother to bring him some clothing at Motel 6 in Framingham where he was staying, Stacer said.

During that visit, Marty Keith noticed two DVDs in his brother’s sock drawer. At that time, Kevin Keith admitted there was child pornography on the DVDs, Stacer said, as well as on the computer and two thumb drives.

Stacer said the man admitted that he began looking at child pornography again about eight months ago after losing his job.

According to state law, each count of second-offense possession of child pornography is punishable by a minimum of five years of prison, or a fine of between $5,000 and $20,000, or by both imprisonment and a fine.

An arraignment date for Keith has not yet been set.
